Electoral bodies and horizontal accountability: A critical review of the Panamanian case

El Órgano Electoral ha sido insertado en mucho países de Latinoamérica como un verdadero Poder del Estado, con competencias en el marco de la rendición de cuentas horizontal. Su rol es el de controlar y sancionar a los demás órganos del Estado e impedir que estos usurpen las competencias electorales que los eximan de la correcta rendición de cuentas vertical. En Panamá, si bien no ha sido reconocido como tal de forma explícita, el Tribunal Electoral goza de plenas competencias para ser considerado el Cuarto Poder del Estado. El objetivo de este artículo es analizar el alcance de las competencias ligadas a la rendición de cuentas horizontal del Tribunal Electoral panameño, entendidas como las competencias de iniciativa legislativa, reglamentarias y jurisdiccionales. Se analizará la evolución de dichas competencias desde la normativa constitucional y legal, pero también desde el ejercicio práctico de las mismas a partir de los fallos de la Corte Suprema de Justicia. Se concluye que existe un continuo y sistemático deterioro de las competencias de sanción y control propias del Tribunal Electoral, lo que pone en riesgo no solo la independencia del órgano sino el sistema democrático en sí mismo.
