Abstract

The judges who interpet the constitution currently face a growing phenomenon called the judicialization of politics. The function of constitutional judges is to make a legal decision on the case that is presented to them, instead of a political solution. This phenomenon that affects constitutional justice has its genesis in the citizens’ loss of confidence in the traditional political bodies, because the people think that the political institutions are not able to resolve their popular demands. For this reason the citizens transfer their claims to the courts of justice, in the search of solutions.
