Abstract

This research originates from a project in conjunction with International IDEA and the Electoral Tribunal, with the objective of promoting the Constitutional evaluation of Panama, through an appropriate methodology for this purpose.


         The National Attorney is the highest representative of the Public Ministry, it is an autonomous entity that does not belong to any of the three State Bodies, Executive, Legislative or Judicial, and that participates in the Administrative Justice process of our country. Its impartiality and transparency in the appointment of the Prosecutor and his substitute at discretion within the mandate of the law is important.


    Constitutional precept 224, the reason for analysis in this investigation, indicates the parameters for appointing the Nation Attorney and the Administration Attorney and their substitutes, which has led us to learn about other rules that collide and have been applied accordingly. which we mention article 200 of the Constitution.


  We expose the historical background of the administration of justice and the formation of the figure of the Attorney General, in our country as well as a comparison of legislation such as that of Costa Rica and Colombia.

Author Biography / See

Miriam Del Carmen Zelaya Pinilla, Tribunal Electoral

Bachelor’s degree in Law and Political Science from the University of Panama, and a Bachelor’s degree in International Relations from the University of Panama. Holds a postgraduate degree in Senior Management from Universidad Latina de Panamá and a Master’s degree in Business Administration from the same institution. Completed a diploma in Scientific, Qualitative, and Mixed Research at the University of Panama and a course on scientific article writing at Pontificia Universidad Javeriana in Bogotá, Colombia.

She has written articles on political and human rights and conducts analyses on Supreme Court jurisprudence in Panama regarding political rights. Currently, she serves as a Researcher at INED of the Electoral Tribunal.
