Abstract

The theory of constituent power in this work proposes an analysis of what the exercise of constituent power entails, with its central issue arising from the assumption that, on one hand, its exercise is a manifestation of human action and, on the other, that this action has a clear and precise political purpose, such as providing a State with a constitution.


The study presents the existence of original constituent power and derived constituent power. To address their differences, the author refers to the extraordinary and temporary political circumstances that typically characterize the expression of original constituent power and the need to justify constitutional amendments.

Author Biography / See

Rigoberto Gonzalez Montenegro, Procuraduria de la Administración

He completed a Bachelor's degree in Law and Political Science at the University of Panama (1983); subsequently, he pursued doctoral studies at the Complutense University of Madrid (1988), as well as specialization studies in Constitutional Law and Political Science at the Center for Constitutional Studies in Madrid (1994). He holds a Higher Education Teaching degree from the University of Panama (2008).

He was a professor of Constitutional History of Panama and Constitutional Law at the Faculty of Law and Political Science of the University of Panama. He has also been a professor in the Master's program in Law at ULACIT and the Latin University of Panama. Currently, he is a professor of Constitutional Law at Santa María La Antigua University.

He worked for over twenty years at the Office of the Attorney General of the Nation. Among his publications, we can cite: Exceptions to the Guarantee of Prior Trial (1992); The Constituent Power (1994); Habeas Corpus (1995); The Control of Constitutionality in Panama (1996); The Objection of Unconstitutionality (1996); Criminal Jurisprudence (co-authored with Omar Rodríguez Muñoz, 1996); Habeas Data (1997); The Constitutional State and Constitutional Defense Mechanism (1997); The Constitutional Principle of No Presidential Reelection (1998); The Intervention of Telephone Communications (2000); The Reform of the Constitution (2000); The Constitution and its Interpretation (2001); The Challenges of Constitutional Justice in Panama (2002); Course on Constitutional Procedural Law (2010); Writings on Constitutional Justice (2010).
