Protection and the right to evidence. El amparo y el derecho a la prueba

Abstract

The author provides us with an exhaustive analysis of the scope and procedural assessment of the protection of constitutional guarantees. Through it, the procedural nature of the right of defense is analyzed, as well as the role played  by the Supreme Court of Justice in terms of interpretation of the procedural figure of protection, to which every human person is entitled. In the same sense, it gives us a weighting of this figure in the merit or probative value, from the appreciation of the evidence, and admission mechanisms, to the  Court’s decision on the scope and competence of the figure of the Protection of Constitutional Guaran- tees.
