Abstract

Our Charter of Fundamental Rights directs us to protect marriage and the family, and their assets. Thus, our Family Legislation clearly lays down the rules to ensure that in equal rights, spouses establish the estate company that will govern their union. However, in most cases such an agreement is not concretized earlier or during the marriage relationship, so autonomously the Law lays down the rules that will be applied to protect the fundamental principle of equality of spouses.
